Many individuals going through bankruptcy don’t know what to expect when they file. Specifically, they are unfamiliar with the pre-bankruptcy credit counseling court. Going through bankruptcy is not easy and can be confusing if you don’t have the right attorneys to guide you. Here at De Novo Law Firm, our attorneys specialize in helping our clients go through Bankruptcy. In order to file for any type of Bankruptcy ( Chapter 7 bankruptcy or chapter 13 bankruptcy), a Pre Bankruptcy Counseling course must be completed by the debtor. This is true in all bankruptcy courts including those located in Riverside, Los Angeles, Santa Ana, and San Diego.
A Pre-Filing Credit Counseling course can be done in one of three ways. It can either be done in person, on the phone, or online. The counseling session goes over three main points: it evaluates your personal situation, discusses alternatives to bankruptcy and sets up a personal budget plan for the person taking the course. This course is set up to show you how to budget your money wisely in the future and to know your limits when it comes to spending your money. When taking the course there are some documents you should have close by. These include top monthly bills, your budget and an approximation of your income and your expenses. At the end of this course you will obtain a certificate of completion.
It is important to note that you go through this Pre-Filing Credit Counseling course through a credit-counseling agency and not through your bankruptcy attorney. When choosing an agency it is crucial that one verifies that the agency is approved to complete these kinds of services. The cost for the course varies depending on what agency you choose but usually ranges from $25-$50.
